I copied a design & broke the copyright law. Is there loopholes in the copyright law that i can win my case?

posted by admin in Law & Ethics

I copied a newsletter’s masthead - the client asked me and i sold 3000 copies of the newsletter to the client. Neither me nor the client new that there existed something like copyright on the design. My design look exactly 100% like the original. There was 2 photos in that the client supplied to me - the same that he supplied the previous company. I just combine them like they did and i use the same font as they did - it’s a free for all font. I got sued vor R1million bucks. The profit i made out of this deal was about R20 000. I got a lawyer but he does not specialise in copyright - must i change my lawyer? the client used me cause the service wasnt good at the previous company and she didnt want to use him anymore. Please help - i need to win this case.

Online Privacy for Alumni?

posted by admin in Law & Ethics

Recently I have discovered my information has been made available online through my high school’s alumni website (and in the school’s printed alumni newsletter). They have posted up my current marital status, state of residence, and pictures of my wife and I. We contacted the person posting this information, but he/she has refused to stop submitting information about us. Nor will he/she take down what has been written. Since my wife and I have not given permission to this, we have emailed the website to take down this information, and are hoping on quick resolution to this matter. If this escalates into a legal fight, what area of law would this be under? Is it ok for anyone to put up information about you through an alumni site?

Legal Help, Online/Newsletter Privacy?

posted by admin in Law & Ethics

Someone has been posting personal information about me in a high school alumni newsletter (as well as on the alumni website). I did not give permission to have such information - residence, marital status, etc. - posted, and have tried asking the person to refrain from doing so again (and taking down posts already up). He/She has refused, so I have contacted the alumni organization to take the information down.

I realize that this will most likely turn into a legal battle, and I have been searching online to find help for this. However, privacy law seems to extend only to business/consumer relations and government infringement on procreation matters. What area of law would my problem fall under?

Anyone think I can recoup what I spent with Constant Contact after I found they may have been over billing me?

For years I have used Constant Contact. It is an online email marketing company that allowed me to upload my customer info and then send out monthly newsletters. I always wondered why I could send out 9000 emails to my customers, which included a savings coupon, but those customers would then come to my site and not use the coupon. I suspected CC was either being blocked or I had more bad emails in my database than I was aware of. I left CC and went over to Godaddy and sent out the 9000 emails…4200 bounced as being invalid. I suspect CC was not showing the true number of bad emails because the 9000 contacts put me in the $75/month range rather than the lower, $50 range. I am thinking they owe me about $25 per month for the past year at least. I have a call in for a manager. Anyone want to give their opinion as to the approach I should take with them?
